On Thursday, October 5th, the approval of the Coastal Regulatory Plan of the Municipality of Talamanca was published in Official Gazette Number 193 of Number 183. This regulation comes into effect from the date of publication and carries significant implications for permit holders and residents in the coastal area. In this article, we will discuss what this change means, the necessary actions that may be required, and how it can affect existing properties in the region.

The New Coastal Regulatory Plan: A Quick Overview

The Coastal Regulatory Plan is a crucial tool for planning and managing development in coastal areas. Its main objective is to balance growth with the conservation of the natural environment and the sustainable use of resources.

The approval of the Coastal Regulatory Plan of the Municipality of Talamanca implies that, from this date, the specific regulations outlined in it are mandatory for the coastal area of Talamanca. This affects existing properties, permit holders, and future developments.

Necessary Actions

The implementation of this new plan may require specific actions by permit holders in the coastal area of Talamanca. These actions will depend on the particular situation of each permit holder and may include initiating the process to obtain a concession from the Municipality of Talamanca or, as applicable, a usage permit from the Ministry of Environment and Energy.

Additionally, for cases where the current property conditions do not comply with the zoning regulations of the regulatory plan, whether in terms of area, coverage, use, density, among others, the Municipality will prepare a study, from which a protocol will be promulgated to establish the basis for continuing or not continuing the concession processes in accordance with Law No. 9242.
